Justice Samuel Alito has dismissed the requests for recusal in Supreme Court cases involving former President Donald Trump and Jan. 6 defendants. He explained that his wife was the one who raised the two contentious flags that were displayed above their homes.
In a recent statement, Justice Alito expressed his wife’s affinity for flying flags while acknowledging his own lack of enthusiasm for the practice.
In his correspondence with members of Congress, Alito revealed that it was his wife, Martha-Ann, who had taken it upon herself to fly an upside-down flag over their home in 2021, as well as an “Appeal to Heaven” flag at their New Jersey beach house the previous year. These flags bore a striking resemblance to those brandished by the rioters who forcefully stormed the Capitol in January 2021, while echoing Trump’s baseless allegations of election fraud.
Alito wrote that neither incident at his homes warranted his recusal. He has previously dismissed requests from Democrats to recuse himself on other matters.
In his response, the individual clearly expresses his confidence that an unbiased and impartial observer, devoid of any political or ideological motivations, would come to the same conclusion. He firmly believes that the events in question do not meet the necessary criteria for recusal. Consequently, he feels compelled to decline the request.
Supreme Court justices have the autonomy to determine whether or not to participate in a particular case. The only potential repercussion for their refusal to recuse themselves is impeachment by the House of Representatives and subsequent removal from office by the Senate. To date, there has been no instance of this occurring in the history of the United States.
While the jurors deliberated in his hush money criminal trial, Trump, who was in New York, commended Alito for his intelligence, courage, and guts in refusing to step aside. Trump took to his Truth Social platform to express his admiration, stating that all U.S. Judges, Justices, and Leaders should display such grit.
Several Senate Republicans wasted no time in expressing their admiration for Alito’s active engagement in the cases, as they took to social media on Wednesday to share their praise.
The court is currently deliberating on two significant cases pertaining to the assault on the Capitol on January 6, 2021, carried out by a group of Trump supporters. These cases involve the charges faced by the rioters and the question of whether Trump is immune from prosecution on charges related to election interference.
According to The New York Times, there was a report about an American flag that was displayed in an inverted position.
Less than two weeks after the attack on the Capitol, an “Appeal to Heaven” flag was flown outside Justice Alito’s beach home in New Jersey last summer. Additionally, the paper reported that a meeting took place at Alito’s home in Alexandria, Virginia.
The “Appeal to Heaven” flag has gained significance in recent times as it represents support for the Christian nationalist movement and the unfounded allegation of the 2020 presidential election being stolen from Trump. Americanflags.com explains that the pine tree depicted on the flag was a symbol of strength and resilience in the New England colonies, while the phrase “Appeal to Heaven” originated from the belief that God would rescue the colonists from tyranny.
The symbol of an upside-down American flag has become synonymous with Trump’s baseless claims of fraud. During the events of January 6, 2021, many pro-Trump protesters were seen carrying inverted flags while chanting slogans like “Stop the Steal.” According to the U.S. Flag Code, the American flag should not be flown upside down unless it is a signal of severe distress due to imminent danger to life or property. Throughout the years, the upside-down flag has been used as a form of protest by both left and right-wing individuals, representing various causes.
Justice Alito expressed his unawareness of the presence of an upside-down flag above his residence until it was brought to his attention. In letters addressed to Democrats in both the House and the Senate, he mentioned, “As soon as I became aware of it, I immediately requested my wife to take it down. However, she refused to do so for several days.”
According to the newspaper, he had previously mentioned that his wife displayed the flag in response to a heated disagreement among neighbors.
Alito wrote that his wife had also raised the flag at their beach house, highlighting that the property is under her name and was purchased using money inherited from her parents.
Justice Alito expressed his lack of knowledge about the “Appeal to Heaven” flag when it was raised, although he acknowledged its origins in the American Revolution. He clarified that he and his wife were unaware of any association between this historical flag and the “Stop the Steal Movement.”
According to him, Martha-Ann Alito did not raise that flag with the intention of aligning herself with the rioters or supporting the attempt to overturn the 2020 election results, where Republican Trump lost to Democrat Joe Biden.
In his statement, Alito expressed his respect for the autonomy of the woman in question, describing her as an individual who thinks for herself and takes her own decisions.
Justice Alito also shared the sacrifices his wife has made due to his service on the Supreme Court. He highlighted the distressing experience of enduring numerous loud, obscene, and personally insulting protests in front of their home, which have persisted to this day and now pose a potential escalation.
In 2022, protests erupted following the leak of a draft of Alito’s majority opinion, which overturned Roe v. Wade and granted states the authority to prohibit abortions. The official decision was subsequently announced by the court in late June.
Last week, Democrats in both the House and the Senate sent three letters to Justice Alito and Chief Justice Roberts. In these letters, they requested Justice Alito’s disqualification from the cases. Additionally, the Senators expressed their desire to meet with Chief Justice Roberts.
Alito preferred to respond directly.
Judicial ethics codes prioritize the independence of judges, emphasizing their responsibility to abstain from making political statements or expressing opinions on issues that they may be required to rule upon. While the Supreme Court had previously operated without its own code of ethics, it took steps to rectify this by adopting one in November 2023. This decision was prompted by ongoing scrutiny and backlash concerning undisclosed trips and gifts received by certain justices from affluent supporters.
The current code does not have a mechanism for enforcement. Last year, the Senate Judiciary Committee passed a bill that aimed to establish stricter standards. However, Republicans have consistently opposed any attempts to dictate the actions of the court.
