The Georgia state House has passed House Bill 1105 with a vote of 97-94. This bill grants police the authority to arrest individuals suspected of being in the country unlawfully, if there is probable cause. Upon arrest, the suspect would be detained and subjected to deportation proceedings, as reported by the Atlanta Journal-Constitution.
The House passed the bill on Thursday (February 29) and it is now being considered by the Senate. If approved, the legislation would mandate local authorities in Georgia to inform federal authorities whenever they have someone in custody who is found to be without legal documentation. Failure to report such offenses could lead to local governments losing state funding or state-administered federal funding.
The Georgia bill has been introduced following the tragic murder of 22-year-old nursing student, Laken Riley, in Athens, Georgia. Laken’s body was discovered in a wooded area near the University of Georgia’s intramural fields just a few hours after she went for a run. The suspect in her murder is identified as Jose Antonio Ibarra, a Venezuelan native who allegedly entered the U.S. illegally in 2022 and had been residing in Athens.
According to the Associated Press, Ibarra had been previously detained by U.S. Immigration and Customs Enforcement (ICE) before his arrest in Athens. However, he was released for further processing. Subsequently, he was arrested in New York on charges of acting in a manner to injure a child. Once again, he was released before ICE agents had the chance to request local authorities to take him into custody.
Protests have erupted in Riley’s community and beyond following her untimely death. Even some Republicans are criticizing President Joe Biden and fellow Democrats over the contentious issue of immigration. Despite the bill being passed, Democrats vehemently opposed it.
Representative Jesse Petrea, the sponsor of the legislation, stated that he dedicated a year to working on the bill. He emphasized the increased significance of the bill following the tragic passing of Laken Riley.
House Speaker Jon Burns, a Republican from Newington, expressed his support for the bill, emphasizing the importance of prioritizing public safety and security in the state. He extended his thoughts and prayers to Laken Riley and her family, while also commending the Georgia House for taking decisive action. Speaker Burns lauded the passage of House Bill 1105 as a significant step towards upholding the rule of law and firmly addressing the issue of illegal immigration.
