House File 2677, which has been approved by the Iowa State Senate, now awaits Governor Kim Reynolds’ decision to either approve or veto it. This bill poses a potential ban on all nicotine vape products that have not received FDA approval.
The bill passed by Iowa lawmakers prohibits the sale of any vapor product that is not on the state’s approved list. This legislation would effectively ban the sale of e-liquids and disposable vapes containing synthetic nicotine, as well as the majority of other vaping products that have not received FDA marketing approval.
On February 21st, 2023, the FDA announced that they would not be accepting a total of 17 million individual tobacco products. These products primarily consisted of various flavored e-liquids with different levels of nicotine content. This decision directly affects the vapor industry trade association, which generates up to 324 million dollars in Iowa alone.
In a conversation with Hans Wilz, a Democratic member of the Iowa House, he mentioned that manufacturers can still sell their products if they apply for approval before the bill is signed into law. Their products will be allowed for sale once they receive the necessary approval.
Don Gier, the Owner of Smokin’ Hot Fine Cigars and Vapors, and the President of the Iowa Vape Association, is deeply concerned about the future of his business. With almost a decade of experience, Gier fears that his store will be severely affected by the impending bill. He emphasizes, “Once this bill is enacted, almost all the vapor products we offer in our store will disappear.”
Gier firmly believes that vaping is significantly safer than smoking cigarettes, which is why he sells them. He points out that other shop owners share the same sentiment and are concerned about the potential risks their businesses may face.
Gier expressed their concern about the impact of the new regulations on their business. They emphasized that their intention was to provide vape products as a means to help people quit smoking, not to encourage them to start. Gier further stated that the implementation of these regulations could potentially lead to many business owners in the vapor products industry being forced to shut down or go out of business.
