Tesla rescinds separation agreements for laid-off employees and promises new ones in the works

According to two former Tesla employees, some individuals who were laid off received a notification on Thursday stating that their separation agreements had been revoked. The employees were informed to anticipate the issuance of new agreements.

In one of the emails obtained by BI, the workers were informed about a document titled “Your separation agreement” with the status being canceled. The notification mentioned that the cancellation was done by the sender to send an updated agreement. This information was shared through an automatic email from Adobe’s Acrobat Sign e-signature tool.

Elon Musk recently sent an email to all current Tesla employees, expressing concern over the incorrect calculation of severance packages.

In an email that was seen by BI, Musk promptly acknowledged the mistake and expressed his apologies, stating, “I apologize for this error, and we are taking immediate corrective measures.”

Several former employees, who were previously offered a two-month severance, received the notification. It seems that the severance packages were not based on the length of time these workers had been with Tesla. Five sources who received the offers told BI that regardless of whether they had been with the company for a few months or several years, they were all given the same number of weeks paid out.

According to other employees, they had not received any information about severance packages as of Thursday afternoon.

According to the Worker Adjustment and Retraining Notification Act, companies with over 100 employees must give a 60-day notice before conducting a significant layoff. Failing to comply with the WARN Act can result in employees receiving compensation of up to 60 days’ worth of pay and benefits if they are not given sufficient advance notice.

Elon Musk made the announcement on Sunday night that he had plans to reduce Tesla’s workforce by more than 10%. The affected employees were promptly notified of their terminations through email shortly after Musk’s internal announcement.

Tesla did not provide an immediate response to a request for comment when contacted by a spokesperson.
