The nurse, Dorothy Wright, and her employer, Maxim Healthcare Services, have been named in a lawsuit filed on April 23 in Los Angeles County Superior Court. The lawsuit alleges charges of child abuse, battery, negligence, and intentional infliction of emotional distress.
The child has been diagnosed with bilateral perisylvian polymicrogyria, an uncommon neurological disorder that impacts the outer cortex of the brain. As a result of this condition, the child is legally blind, unable to speak, and experiences seizures. Additionally, the child’s underdeveloped hips hinder their ability to move.

According to the complaint, Steven Aguilar mentioned that on October 4, 2023, he was working in his home office when Wright informed him about his son’s excessive sweating. When Melanie Aguilar arrived home, she discovered her son in a state of unconsciousness, surrounded by a pool of sweat. Wright then informed the parents that the night nurse may have caused harm to the victim’s leg.
The mother instructed the nurse to dress the child in a short sleeve shirt and administer Tylenol. However, Melanie Aguilar later expressed that if she had been aware of the true extent of his pain and condition, she would have opted for a cortisol injection instead.
The mother immediately rushed the boy to the emergency room, seeking medical attention for his broken leg. Doctors performed X-rays which revealed that the leg had been fractured as a result of physical abuse, according to the complaint.
According to the complaint, Ms. Aguilar experienced immense distress as she witnessed her son’s struggle to breathe and observed his oxygen levels steadily declining.

After the incident, Child Protective Services proceeded to question Melanie, who promptly reached out to Steven.
Five days later, law enforcement apprehended Wright and formally accused her of four counts of willful cruelty to a child. Currently, her criminal case is still under investigation in the Los Angeles County Superior Court.
According to the lawsuit, there is additional home security footage that captures Wright allegedly punching the child on seven separate occasions within a two-month period.
According to the complaint, Wright has been employed as the victim’s nurse since September 2021.
Suit accuses service of hiring other abusive nurses
Ryan Saba, the family’s attorney, claimed that the home health care service has a track record of employing nurses who abuse patients, including vulnerable children.
According to a news release, Saba stated that this case involves another unfortunate incident of a child being abused by Maxim and a nurse. The purpose of this lawsuit is to ensure that such behavior never occurs again and no other family has to go through a similar ordeal.
