10-year-old boy escapes homicide charges for crime committed 2 years ago

A classmate of a 10-year-old boy from South Texas recently reported that the boy threatened to kill him. During the investigation, law enforcement officials discovered that the boy claimed to have killed a man two years ago without any reason. However, due to state law, the boy cannot be charged for this crime.

According to a news release from the Gonzales County Sheriff’s Office, a student in the Nixon-Smiley Consolidated Independent School District recently disclosed to school officials that he had shot and killed a man in 2022. This revelation came during an investigation into an alleged threat made by the student towards another student on a bus last week. The identity of the child has not been revealed.

During the investigation, the child provided firsthand details regarding the tragic shooting incident that took place on January 18, 2022, in Nixon, Texas. The incident resulted in the untimely death of 32-year-old Brandon O’Quinn Rasberry. Nixon is situated about an hour east of San Antonio.

During the investigation, the child informed the authorities that he had never come across Rasberry before and had observed him wandering around the RV earlier in the day.

According to the release, the child was questioned about whether he was angry with Brandon or if Brandon had ever done anything to provoke his anger. The child responded by stating that he was not mad at Brandon and that Brandon had not done anything to upset him.

Investigators discovered the gun used in Rasberry’s murder on April 12 at a pawn shop in a nearby town. They were able to match the shell casings found at the crime scene with the gun used in the crime. However, due to the child being under the age of 10 at the time of the crime, he cannot be charged in connection to the 2022 homicide. This information is based on the Texas Penal Code.

“It’s absolutely tragic to discover that it was a 7-year-old who committed this senseless murder. It’s difficult to comprehend,” expressed Jonathan Fojtik, the brother of the homicide victim, in an interview with CBS affiliate KENS. “Brandon was a kind-hearted individual who would go out of his way to help anyone in need.”

The child is currently facing charges in connection with the threat made against his classmate. He is currently in juvenile detention and is awaiting a court date, according to the release.
